These links are in my website’s backlinks list.
Should I use disavow link tool to remove these links from the list of backlink?

No to both. There is absolutely no point in using the disavow tool unless you have received an “unnatural links” warning from Google. If you haven’t received that warning, disavowing will have no effect, and is just a waste of time.
I’m not sure what your reference to 404s means. If you are saying that some of the backlinks point to non-existent pages, that is, they produce a 404, then Google will simply ignore them. They won’t do you any harm in SEO terms. However, if they are links from genuine sites with visitors that might be interested in your products or services, then it might be worth trying to contact the sites concerned and ask them to correct the links. That way, you might get some useful traffic from those visitors. And, in any case, you should put some effort into ensuring that you have a friendly customised 404 page, so if visitors do reach it, they will still be able to find the information they are looking for.
SEO point of view: 404 is not important for you as it is on other website.
Visitor point of view: it does matter. You should follow Mike’s suggestion regarding this.
disavow links: if you think some backlinks are low quality and harm your website’s reputation or ranking then should use it.

Don’t worry mostly website have backlinks from 404 pages and google understand that pages could have been remove and you don’t have any control on others websites therefore Google ignore those links
Hello Friends, as of many other sites, I also encountered many sites hit by penguin, and submit a disavow link report, but no effect yet, can anyone tell me anything and everything about “Disavow Link Tool”.
Many of my client said even after the unnatural links are removed they saw the links in the webmaster tool. I am not able to get this point, even after disavowing, how it is possible, can anyone also experience the same as me.
I want to submit disavow links to Google, is there any size specified for the tool file size that i submit to Google for “Disavow Links”.
Someone suggested me to put comments or reason along with the link, to which i want to disavow. Is this necessary to do this, is there any effect to it, or it is just a formality?
Let me repeat what I said earlier - and what has been said many times in other threads: The only time to use the disavow tool is if you have received an “unnatural links” warning from Google - and even then it might have no effect. If you haven’t received such a warning, just forget about it.

It takes time for disavowed links to disappear: possibly several weeks or even months.

No . But it’s highly unlikely you’ll have many entries in the file. Remember, you can disavow an entire URL in one line. You don’t have to disavow each individual link.

Neither. Comments are for your benefit. They might be useful to you when you are reviewing the list. But Google doesn’t look at them, and they have no effect on the disavowel process.
As we know that links are of 2 types, do-follow and no-follow, should I have to report both types of links, to Google in my “Disavow Link File”.
I have submitted a disavow link report to Google, and now I find that some of the links are submitted by mistake and now i want to re-avow them, is there any way to re-avow the disavow links?
That would seem to be warning enough to be very, very careful when using this tool.
You could try simply uploading a new file, as they say
Note: Uploading a new file will replace all previously uploaded ones.
However, if the original file has been processed, I doubt if this will have the effect you want.

Actually, that is not true. I have had 2 successful recoveries by using the disavow tool without doing anything else and with no “unnatural links” warnings in place.
I tend to believe what Matt Cutts say. If you see weird links coming to you that you know nothing about, disavow them. Might help Google spot the spammers too. I do all the time, no ill effect.
