If you mean which of these specs is better, the one that lists the most browsers - the first one.
Because not everyone is using the latest browser, and no-one is going to update their browser just to view your site. A theme that works in IE9 will work in IE10 - take a look yourself - so the first one can probably be extended to include IE10. One that admits it can’t work with IE8 might have real problems with the older browser, although it might just mean that it uses css to give some effects that IE8 and below can’t display perfectly but what’s new about that? Of course it could mean that the developer has no way to reliably check in the older browsers, or that the theme was developed before the latest ones were released and the developer hasn’t updated things to guarantee it looks the same, even though it probably does look the same.
A theme to avoid would be one which mentioned only the older browsers such as IE6 and IE7, because that means it is old and probably not been updated for years. And it could be a bit plain looking too.

this theme - er leaf - would it work on IE8? Because I think 24% of people still have IE8.
I think the answer is yes - but maybe not all features would work properly.
