Yes, he does. And it cannot be a lawsuit summons either. It has to be a written collections notice.

I’m completely pissed. This company has called me 3 times today and once yesterday. I missed all of their calls because my phone wasn’t on me. I called back to see who it was. Some ***** answered and was giving me his ******* attitude. I told him never mind and he said “THANKS DON’T CALL BACK” how rude!?

To be exact. If they call you again, tell (don’t ask) them to identify themselves. If they state they are trying to collect a debt, tell them to identify themselves or they will be in violation of federal statutes.

Also be sure to ask what the nature of the debt is in regard to. Is it for personal, non-commercial and house-hold purposes? Or is it a business debt? Which phone line is the company calling? Your home or business number?

And of course, last but not least, I am not a lawyer. Neither is anyone else here (most likely anyway). We can offer our insight, but we cannot provide legal advice.

I just did some research on that same phone number and I learned that NCO Financial is a kind of agency known as a “junk debt buyer” - which means that they buy old, outdated debts from companies we might have had a relationship with in the past, and then try to collect on that old debt even though it is very probable we don’t owe on it anymore. Oh yeah, I’ve heard about NCO Financial. Scum of the earth if you ask me. I haven’t dealt with them but I do know people who have. Usually getting slapped with an FDCPA and/or FCRA lawsuit in federal court is enough to get them off of a consumer’s back.

It’s HSBC (a bank). Do you have any outstanding debts with them by any chance, such as a credit card, mortgage, or other bills that need to be paid to them?

YES $604 balance and $36.00 late payment, but they close my account and send to collections,
now they are calling to my cellular to.

Then you’ll want to read this post, then contact an attorney who specializes in representing consumers in debt collection abuse cases. Also note the last time I checked, it is unlawful for a collection agency (or anyone acting as a debt collector) to contact you via your cellular phone since it actually causes you to incur a charge.

I started receiving calls from this number: 1-800-395-8289, a couple of weeks ago. They call me 4-5 times a day, sometimes starting at 7 in the morning when I am still sleeping. I do not have ANY credit debt, nor have I ever. They are also calling my cell phone - which Dan just mentioned is illegal. I googled this number and found many many sites complaining about it and having the same trouble I am having. It seems to me that this is a scam, not a legitimate company. Any idea what I can do to keep them from calling? I do not want to send my personal information because I do not OWE a debt.

Then what you need to do is get their registered business address, file a complaint with the FTC (Federal Trade Commission) and start looking for an attorney who’s willing to bust them in the chops for you. HARD
