I was involved in a situation a few years back where a web designer died suddenly - and his clients discovered their domains were registered to him and not to them. You could contact domain.com to via their transer form process. Although you don’t meet the ‘classic’ corporate requirements you can still demonstrate enough to likely make this process work.

In the transfer form consider the following:
1:[INDENT]Prepare a link to your Whois record.[/INDENT]
2a:[INDENT]You can find the address of HostOnce[/INDENT]
2b:[INDENT]You can state the relationship to HostOnce[/INDENT]
2c:[INDENT]There is fairly significat proof that HostOnce no longer is servicing their domain registration customers. It is unlikely that you’ll be the first self (non) corporate registrant that is attempting to get their domain; therefore if you can show reasonible grounds that you are legit and should have rights to the domain then it has better opportunity to work.[/INDENT]
2d:[INDENT]You will state that you keep the account in good standing that you use this in a way to promote and deceminate your information, as they are unwilling to answer the phone, emails, or information accessed via web forms, they have blocked your right to continue operating this domain when when you reach the renewal anniversary date on 2012/08/14[/INDENT]
2e:[INDENT]Although, this is important, you may first try doing 2a to 2d and Domain.com may sufficiently understand your situation an not require a not document notarized.[/INDENT]

In case it helps anyone else, I spoke to the Domain.com Support team on the phone today, and they told me that it was okay to submit a statement saying that this was not a company, in lieu of the company registration documents.

I shall of course report back if this turns out not to be true when they examine my submission in a couple of weeks’ time.

Mind you, I now need to phone them again to discuss precisely who they will accept as a “public notary or equivalent” signature; will be a tad irritated if I end up having to spend £150 on a signature…

Generally a Judge, Lawyer, Notary Public (least costly) or Public Official are all able to provide notifications. Good Luck :slight_smile:

Yeah, the trouble is that in the UK, a notary public is far more expensive than a sollicitor, because they only really handle official international stuff. So I’m getting quoted £150 for a signature.

Wow $50.00 CND for the same thing here.

About 6 months ago, I got a Justice of the Peace (NZ’s standard notary service) for NZ$ZERO. As NZ is modeled on Oz/UK, give the local JP a try.

Mmm. After a conversation with them over the telephone, they appear willing to accept a solicitor’s signature (the equivalent thing in the UK). The confusion seems to stem from the wording of the form, since there is such a thing as a notary public in the UK, but it serves a different function.

Oh well. Will get the solicitor to sign it and hope that Domain.com don’t just take my money and deny the application.

My Response to ICANN Whom directed me to talk with Xibig.com (THEY ARE THE SAME AND ONE ) BUT NOW THEY HAVE A PHONE…use it…or if you do not beleive it your self go to their web address and check the contact’s page…!!!

Hello Everyone,

I have read everything on this thread. I have had my domain name with HostOnce for almost 15 years. Never had a problem with service or support until now. Which makes sense since they are no longer in business.

I have filed a complaint with BBB and ICANN. I don’t expect to hear back from either of them.

I have called my “Registrar” which is Domain.com and they couldn’t do anything until they got a hold of HostOnce.

I did a “Transfer Request” through GoDaddy, and they also cannot do anything until they hear back from HostOnce, or HostOnce changes the information on my account.

DOMAIN.COM phone number = B 403-3568[/B]. Press 2 for “Service”, then press 3 for “Have had account since before May 30th”.

They are already closed for the night, so I will call Domain.com again tomorrow with the eMail address that CPL PRO listed: billingmng@xibig.com & info@xibig.com (from their website).

Also, I check my WHOIS a couple of weeks ago and it said the North Carolina & New Jersey address for HostOnce. Today when I looked up the WHOIS, it says that HostOnce’s address is in Australia. And that my account information was updated on Aug 27, 2012. Seems a little fishy to me. But maybe they are going to change the info. My fingers are crossed.

UPDATE:

I called Domain.com again today to give them that email address at XIBIG.com

Talked to a person named Paul. He said as of almost 2 weeks ago (Sep 1, 2012), Domain.com is allowed to change the “Technical Information” to whatever you want (probably your name/email), if HostOnce doesn’t reply within 2 hours of an eMail to them (from Domain.com). Apparently, the person I talked to at Domain.com yesterday didn’t know of that change. Paul said he will let the support team know that they have the approval to change it now.

So, if Domain.com is your “registrar” (look this up on WHOIS), call them at: (800) 403-3568
When they make notes on your account, they will give you a Reference/Case Number. The next business day, call in with that number and they should be able to change it for you.

You can change it to whoever you want. They don’t require you to stay with them for hosting or anything else.

Please Note: Domain.com sends out their eMails in a batch at the end of the night, so you might not get authorization to change the info on your domain until the next business day.

As of this morning, not all of the Domain.com support is aware they can do this for you. Also, those email addresses were not listed on my domain, but after some checking she told that what I read on here was correct and they would try to email the address listed on the account and if did not here back from it, they would update the information to my contact info. She gave me a case # and indicated there was no need to call back as they would email me at the email address I provided for the updated information.

I remained nice throughout our 30 minute phone call and it looks like I may get my domain back. I will update on the final results.

UPDATE!

Only about 7 hours later and I have an email to login to my new legacy account with domain.com to control the domain that I thought I lost to hostonce.com.

I’m Up-and-Running Again!!!

After a few more days of dealing with the transfer, I am up and running with my site again.

Everything is in my name. Out of Domain.com and into GoDaddy. I will be uploading my files to the FTP, so I should be live by tomorrow.

After getting the domain out of the Registrar’s name (domain.com), there are still a few steps that you have to do in order to start uploading files to your domain. Each step seems to take another 24-48 hours, but that’s fine, I finally got my site back after 6 months.

GoDaddy and Domain.com were awesome with helping me on this. If you have any questions on the “steps”, post it here and I will try to answer them.

I actually just used 000webhost and pointed to it via the domain.com control panel to make sure I could get it to work. I had the site backup with 7 hours of contacting Domain.com. I am in the process of transferring to Godaddy now, since they are easier to integrate to Google Apps.
