I was recently in a similar situation and my friend who runs a hosting company gave me some very useful advice. If you 1st and 2nd emails don't have the desired effect, find the name of the hosting company then look up who's responsible for DMCA complains, you can find this info at www.copyright.gov.

Then use the template available below, provide all the information required:

Why do I care if someone rips my site design? I don't see why this is a big deal to most folks. Look at all the people using the MSN tab look and feel. Look at all the people using the Amazon look and feel. If someone is ripping off your design, then you must have a pretty good design.

Myself – I’d take that as a compliment. It’s not worth my time to hunt someone down for such a small thing that will likely never surface any issue for me anyhow. Why should I spend my valuable time hunting this person down VS developing sites for my clients?

Sorry – I disagree with the article’s aim. This will cause people to spend time on something useless with little return.

I agree it seems wrong for someone to lay claim for a design they did not create. Fact is if they do so their client will soon catch on when they ask them to tweak the design a bit.

Nice article. While I wouldn't mind as much if someone ripped my layout, my content would be another thing. Layouts - unless one of mine that was really unique was ripped - just aren't important enought for me to go though all this hassle. But content is an entirely different matter. Still, great info on what someone could do in a similar situation.

This is almost a three year old article... but.

I really would mind, not all of us are designers. In my case I have paid a company $12,000 additionally for an exclusive design to go along with my AJAX application. Believe me I would definitely see "red" if i find someone ripping of something in which i have invested a lot.
