    Jail for SE Spamming ?

Can I go in jail because I am doing search engine spamming? Does search engine spamming meaning website optimization ? what about overoptimization?

I don't know what the law is in Romania, but I'd be highly surprised if the people making laws in your country even knew what search engine spam was, let alone be concerned enough about it to make it illegal. The real question for you should be "should I do it" and the answer is no, don't.

Search Engine spamming, that is to use trickery in your html to increase your rankings, cannot put you in jail in any country. The worst thing that can happen to you is you get booted from the search engines' indices.

Is it worth doing? Maybe. As long as you understand the risks associated with doing it. Are the risks worth the reward (e.g. will you make enough money doing this that you can survive if removed from the SERPs?)

Do I recommend it? Definitely not.

For those saying you can go to jail for search engine spamming, I'd like to remind you that search engine is not the same as email spamming. While you can go to jail in the U.S for email spamming, as Stymiee correctly stated, you can not go to jail for search engine spamming. As he also correctly stated, the worst that will happen is that search engines will remove your site from their indexes.

The only law I know about that's being used to send spammers to prison is the CAN-SPAM law in the USA. Even that doesn't cover search engine spam. If anyone wants to discuss laws that do make search engine spam, I'd like to hear about it, and please post examples not just "yes" posts.

Don't tell him that!!! The only reason people are saying you can go to jail for spaming is so he won't do it!!!

Here's the truth about spamming, if you live any where on planet Earth.

First spam= 1 year in prison.
Second spam= 5 years in prison.
Third spam= Strike three, life in prison.

SE spam won't send you to jail, but it won't benefit you in the long run either. Spend time doing good things on your site rather than spamming search engines and you'll see more long-term benefits.

That's not because of spam, though... the Nigerian e-mails are fraud, not just annoying.

Heres the difference between e-mail spam and search engine spam:

E-mail spam - you are actively sending out e-mails to servers other people own, consuming their resources.

SE spam - the search engine is crawling your site on its own, using up its own resources and the time and ultimately the time of people who use the SE trying to find relevent results.

Both can make you a lot of money, one can, in the US, send you to jail.

If you want to work 24/7 maintaining top listings be a SE spammer. If you want to build a site and then relax, or even build more sites, then build quality sites with real content. Both do require a lot of work, but I believe in the long run building real websites with real content means more $ for you. It also means people can actually find what they are looking for when they use search engines -- and that means your site.

Yeah, sorry, thats right - he was charged with fraud and attempting to thwart the course of justice. The spam part didn't get a mention.

The hidden text did not land him in jail.
Go and find some law that works that way and then report back here.

What was it that got him caught?

    - What he was purporting to sell [scam/fraud]?
    - The (illegal) content of the hidden text (and not the fact the text was hidden)?

The best thread I`ve seen here!
I know Romania very good, I suppose SEO spam is the last thing to be inprisoned for in Romania. It`s more dangerous to smell flowers...

But if serious I`ve heard that some spammers were executed (shot) in the North Korea.... (it was difficult to catch spammers there because they don`t have internet all)
