I know topics like this have been answered many times before - I’ve read so many sample T&Cs recently!

I design, build and SEO/SEM websites. I also host them using a 3rd party reseller package. My biggest concerns are that:

  • I make a mistake in someones Adwords account and it costs them money.
  • A website goes down due to server issues losing the client money.
  • Some other issue happens that will cost the client money such as a payment gateway not working or some issue with a shopping cart.

Does anyone have an example in their T&Cs that relate to the above? For example, in regards to hosting I was thinking along the lines of:

I shall use reasonable endeavours to make sure the hosting services are available to the Client 100% of the time, but because the Services are provided by means of computer and telecommunications systems, I makes no warranties or representations that the Service will be uninterrupted or error-free and I shall not, in any event, be liable for interruptions of Service or downtime of the server.

Would this stand up in a court of law? What clause would I need that indemnifies me should I take over someone’s SEO and their traffic dives?

I think the best option for you is to get your own proper qualified legal advice.

If you take legal advice from forums like these and you end up getting sued for something or other, I doubt very much any judge or jury will accept a defence of so-and-so on sitepoint or wherever told me it was ok :smiley:

Im interested to hear what freelance SEOs and Developers have in their T&Cs and any advice they have on this aspect for a newbie.
