    it is the poster ... he is liable for his cmments in legal matters . However , the site owners mostly take the right of posting it , if they want to as promotion for their site ... i think .

    I think it's exactly the opposite...
    The owner is responsible for the material published on his/her site, and can use texts posted in whatever way (s)he wants (but it's of course courteous to ask first)

    Actually it depends on the agreement.

    If you read our guidelines here, we specifically say that the poster retains all rights to their posts and we reserve the right to use it in promoting our site.

    If you read Yahoo's agreement, they claim ownership of everything on their servers.

    Wayne, that's interesting -

    What drove that decision? Was it to limit liability ("He said it, he owns what he says...Don't blame us."), or were you just being nice, not taking ownership of everything posted?

    It depends on the agreement, but legal action can and WILL fall on the site owner if they fail moderate the actions of thier members. Take in account the lawsuit filed today againest ebay for a users comment on the feedback system. perfect example.

    Most times there is a large gap between suit filed and suit won.

    I don't worry so much about suit filed. Anybody can hire an attorney.

    hey - exhibiting due diligence in whatever could reasonably be held as "yer responsilibilities" is a good way to avoid trouble - legal, commercial, and otherwise
