    Someone has copied my site! What can I do?

    Someone has copied my site, and is now claiming that they are the original designers! They are trying to shut down my site and have already contacted my hosting company and claimed copyright infringement. (They asked my host to shut down my website!)

    Is there anything I can do? Would it help if I applied for a copyright from the US Copyright Office?

    How can I "prove" that they copied me, and that I did NOT copy them? What can they do? Can they sue me?

    It would probably be useful if you could prove, that you have been around longer than they have. Try the Internet Wayback Machine. Maybe your site is in their archive.
    Don't know if that is worth anything in a court, but you could at least give it a try.

    Or maybe look at Google's cached version of their website?

    Can you provide links to your site, and to their site? I'd be interested to make a comparison...

    Try and look for any beta-versions of the site, in particular .psd files would be useful.

    Take a screenshot of their site and save it.

    Depending on other things, more can be done...

    I'd rather not provide the links.. as I think they are also in these forums. The copy of my site is almost word for word, picture for picture. They have changed a few things around, but not much. (They changed the menu wording, but didn't change the colors or "fly-out" style, etc..

    Most of the graphics are identical, the layout is identical, colors are identical, etc..

    What is a .psd file?

    A .psd file is a Photoshop file.

    Basically, what Platinum is saying is do you have the original graphics files in which you 'composed' your site's graphics.

    If somebody has taken graphics from another site, all they will have is a .gif or .jpg version.....not an original, so it will help to confirm that you did all the work yourself.

    Run a whois search on his site and compare it to your site's whois. Whenever you run a whois on a domain name, it should list a date for when the record was created.

    For example:
    Record last updated on 12-Jul-2001.
    Record expires on 07-Jun-2003.
    Record created on 06-Jun-1996.
    Database last updated on 19-Jan-2002 01:44:00 EST.

    Granted it may not prove who had the design in their hot little hands first, but it does prove who's site was online first, giving a higher level of credibility.
