Exclamation Using Images of any Wallpaper, in a commercial projects. Is it legal?

    Hello Everyone,
I need some Cars,Trucks and ships images for a website design project.
Now the question is Can I use Wallpapers to extract the pic and use in my website? If :

    - Wallpaper is officially available on company website
    - Wallpaper is downloaded from any wallpaper website
    - Wallpaper is taken from image sharing site like Flickr or Webshot
Remember Wallpaper will be used after modification

Secondly, Can i use Game screenshots legally ( cars from NFS, Assaulter from CS ) to extract Car Image or charachter image?

Everything that is not allowed, is forbidden. On that note, you can't use anything without the author's consent, especially when it comes to editing. And you definitely can't use game screenshots (without the author's consent).

That's fine, you own the rights to the photo.

Who is going to decide that the original PHOTO use in any project, was taken by user or was part of any wall paper.

The person who creates a creative work (including a program, photograph or novel) owns the rights to it. This includes wallpapers that are available for download. You need the author's permission to use the images.

And to make matters more complicated, you should be sure THEY own the rights to the images they used in the wallpaper to begin with. If they don't, and you use the wallpaper in your own works you could be liable for using the images even if you paid for them. I've heard several stories about people who thought they had permission to use images and found out (from the legal deparpment of stock photo houses) that they didn't. It could be very costly.

A court of law if it ever comes to that.
