Use double opt-in for sign ups and be sure to comply with the can spam act.

The CAN SPAM act is a piece of US legislation designed to regulate or at least advise companies on how to proceed when sending out commercial email. It has rules guiding what messages must be included in an email, how optouts work, how to title emails and so forth. While this is limited to the US most ISPs have adopted the policy and therefore it's common practice for every legitimate emailer to follow regardless of location.
