    Is it legal to sell stats?

    I was curious if anyone could awnser for me if it is legal to sell web stats of my clients domains? Does the client own the stats or do I? If I do, can I share them outside of my hosting company? Who makes the rules governing this?

    Thanks for any and all feedback on this issue.

    That would completely depend on your TOS.

    Mind you I think you would very quickly be out of business if you sold your clients' web stats.

    Come on! Use your common sense. Whether you've allowed yourself the right in your TOS or not, treat people like you'd want them to treat you.

    Do you really want your dry cleaners telling your mommy about that "strange stain" they found when cleaning your suit?

    What do you get out of selling stats of your clients? Why would you want to do this? It is not your site and you do not have much control over it (depending on what is in the contract) but I have never even thought about looking at my client's stats. I barely have enough time to look at our stats

    I would imagine that the site owner could, irrespective of your TOS, claim an implied confidentiality agreement. Unless you have told them clearly that you will be selling their confidential business data, doing so would likely be a very bad thing. Compare this to a password protected site, would it be appropriate for you, as the web host to go around posting lists of their passwords? You may not have an agreement that says you can't but since it's not your site and in your case, not your data (all you are doing is generating a report) selling it would not be your right. In any case I am not an attorney, if you consider actually doing this talk to an attorney first.
