Is my design being copied? Opinions?

    Hi guys,
While checking my site referrers, I happened across a site the is , well, KIND of using my design.

    My site is http://www.redflystudios.com
and the "Copied" version is here:
    http://www.fleetforum.net/

I know the colours and certain elements have been changed, and I know imitation is the highest form of flattery, but is there anything I can do?

    Am I just being silly?

I would say just about everything except for your header and colors (and thank God they didn't steal your logo!) .

However, it's a close call as to whether there is anything you can do or not. If the site paid another designer for the design, they might be more apt to do something than if they stole it on their own. I'm not sure what I'd do in this situation.

by the way... congrats on the mambo award.

Yes, they've stolen your entire site design concept plus they directly stolen the images - they've not even bothered to rename those images (e.g. searchbox.gif).

This is copyright infringement, pure and simple. Contact them first to see what they have to say about it - I would include screen shots comparing each stolen bit like-for-like and inform them that if you do not recieve a satisfactory reply, you will contact thir host to to take down the site.

Basically, at the very least you should be getting paid for designing their site and supplying then with ready-made gifs.

Thanks for the replies Linda and Shadowbox. Ill do some comparison screenshots later on and contact them. I need to do a bit more research on what constitutes exactly an infringement and what I can proceed with.

Just wanted to get some feedback here first.
    Thanks again.

And Linda, I would be more concerned if they stole the .... content.

it looks fairly similar alright, he couldnt copy the logo so he did his own with a menu down the right to compensate for your nifty navigation.

i wouldnt say it was too hard to change the colours god love him, definitely contact him or at worst send a bill

They're definitely using your design. He's even linking to images on your site. Look at the source for the footer -

    his:

    copy

Don't worry, the website will not be used for real and is still a study to Joomla. The live version of fleetforum is still fleetforum.org.

OK, fair enough, he is copying. But in fairness, he has come to this forum "trying" to explain. I am willing to allow it as long as it is for a learning purpose and as long as he gives credit where it is due. Stealing and hotlinking is NOT the way to do this.

Yeah, that's a balanced outlook. My comment was pretty harsh because I didn't read raap's post at first.

No, I'm not the owner or developer. Just the person who knows more about this website (non-profit,humanitarian aid agency) and there purposes.
Keep in mind that joomla is still open source and that good examples of templates are rare. So, all the credits are for cianuro and his good design.

In this case, it's fun to:
    1) rename footer.gif to footer2.gif
    2) change YOUR HTML code to read footer2.gif
    3) put up another footer.gif, whose content is left at your discretion and good taste :-)
