    Collecting from dishonest advertisers

    A few months ago we setup a deal with the folks over at www.axtionnetwork.com to host a million popups over two months.

    We just finished and have tried to contact them to collect the money due to us, about $5,000 dollars, without avail.

    I'm considering taking legal action, but I don't know if it's worth it for 5 grand. What do you guys recommend?

    Have they explicitly said they won't pay, or have you just not been able to contact them?

    I wouldn't jump to conclusions if it's the latter, because in a recent thread, beley had the same problem. He later found out that his client's email was down, and the client paid him promptly thereafter.

    It is the latter. They actualy stopped responding to the E-mails when we started mailing them to let them know that their campaign is coming to an end.

    They were very, VERY prompt prior to that while we were discussing, and assured us that payment would be made (with a signed insertion order) 7 days after the campaign has ended.

    I'm very scepticle, they have three more days, though, so I should wait it out a bit, I guess.

    If you cant get to them, and you dont want to take legal action, you could always factor off the debt to a professional collection agency..they'll take care of it for a 20% or so fee..

    better than nothing..

    I hope you had them sign something.

    A couple things you should include in the contract is that there is a 15% late fee after 30 days, and it'll be compounded again every 30 days after that.

    You could also include something about if legal action is necessary they will also be billed for the legal fees.

    Although I think you may be able to take this just to small claims court. Most small businesses that bill people have a few people each month that don't pay up. So one day a month they take them to small claims court. It costs less than $100 to pay one of their employees and the court fees, but they collect a few grand.

    Yes, I have a signed insertion order with states that they have to pay, and that I have to deliver services first, etc.

    It's basically the contract.

    I guess I'll wait a few more days. I'm calling them today, though, to see if I can find out what's going on over their.

    What a surprise. Numbers are out of service!

    I did manage to get a ring out of a number in the contract, however no one picks up. The voice-mail says that they haven't setup their mail box yet.

    That sounds pretty shady. Type their physical address into an online phone book (Yahoo has one) and see if it spits out a different phone number. Hopefully it will.

    I've already tried that, same phone number (which is disconnected.)

    They did provide a different number in the contract, which goes to an answering machine which does not collect messages?!?

    I'm guessing you already ran their domain name through a WHOIS search and tried calling that phone number? Another thing you could try, run a search for the home phone number of the administrative contact. I'm sure he/she won't be thrilled to receive a business call at home, but too bad.

    Try contacting their ISP, they might have some additional contact information, although I'm sure they can't disclose it. Worth a shot...

    I dialed every number whois ran. I also ran the number through Yahoo people, the business address IS his home address.

    I might just hire a collection agency to save me the trouble.

    I've gotten intouch with them. They don't seem to happy, however to avoid legal action say they will pay up ASAP.

    Lets hope they are telling the truth.

    Do you require a down-payment from your advertisers before running their campaign? If not, this may prove helpful in preventing other situations like this from happening again.

    Speaking from a publishers point of view, I would be extremely upset if my advertising network couldn't pay me because they haven't received payment. In fact, a couple affiliate networks have been shut down as of late because of this exact problem, or so they say.

    Not trying to break into a lecture here, but it's a networks responsibility to collect payment from advertisers and pay their publishers promptly. A publisher should never have to suffer because of a networks failure to collect payment.

    I'm very pleased to see that you have been working hard and bending strings to collect the money that you and your publishers have earned.

    We normally require full payment before the campaign even begins, however this deal was one of the few exceptions to the rule.

    The company seemed very professional, sent a signed insertion order and just won our confidence. A mistake we won't repeat in the future.

    We also have a policy of digging into company money to pay publishers if the advertiser fails, however, this is a last, a very last, resort. If we do this to often we will end up as a listing on FC, and thats not good

    Dealtime tried to do the dirty on me (and many other affiliates). Didn't respond to any of our emails, said 'check was in the post' when it wasn't, blah blah blah. I threatened them with legal action. They didn't even bother to respond to the court's orders within the requested time. To cut a long story short - they eventually paid up.

    If anybody tries to cheat you - get your lawyers onto them. We affiliates and webmasters need to fight back against dishonest advertisers and merchants.
