That really sucks! You've gotta sink pretty low to pull a stunt like that.

I have a question though, for all the folks who are suggesting legal action -

A Whois lookup on "www.hercules-data.com" shows Registrant, Admin, Tech, and Billing contacts being in Hong Kong. Their site says they operate in HK and on mainland China.

Is it possible to bring any kind of effective legal action against a company operating in China?

I know a lot of the big software companies are constantly complaining about the copyright infringements over there, and about their lost profits.

Don't mean to be negative, but what are the chances of success in threatening them with legal action?

    Success!!!!

    Thanks for your support guys!

Success!!!!! Seems like the emails did the job

I ended up sending emails to all the top guys in the company blaming their web designer they might have been employing (didn't want to blame the company directly, that way they can blame someone else and keep face - more likely to get a resolution) and i threatened legal action if we couldn't resolve the matter in an amicable way...

Well it's done the job because the original url: http://203.186.11.193/ is now a directory list and the main url http://www.hercules-data.com is back to their original design.

Well the matter is solved (although no apology or anything from the company) without expensive legal fees - guess i've been lucky this time.

I have a few ideas now for adding an active layer of protection to my sites in the future... (BTW: those who were asking about how i found the site - well i was looking through my server logs and found that the site had been requesting images from my server... thief caught in the act )

Anyway, thanks again for your feedback and help, it's good to know that there are people you can turn to for a bit of moral support when these things happen!

    Cheers,

    Way to go!

Maybe you should send them a proposal offering your design services?

    That really is beautiful work.

SubBlue, I hate to be the one that informs you but it look as though there back up to there old tricks.

    look here > http://203.186.11.193/

At the time of viewing 11.14pm Australian Eastern Standard Time (GMT+10.00) that url was displaying your copied site again.

Time to pull out the big guns I would say. I have a lot of legal contacts who could answer some questions for you if you have any. Send me a pm if you want some help.

    Micmar.

Bizzare - i only see a directory listing (now 14:54 GMT) like earlier. They really are a bunch of coyboys - try clicking on the mail.html file and you get to their internal mail system...

hmm this is wacked. When I first read the thread the page loaded the copied site and did so right up until I posted my reply.
I had cleared my cache and temp files before I posted as I wanted to make sure but it still loaded it. I have now rebooted and checked it in both major browsers and the directory listing you referred to is now visable. Strange.

Have a look at there html files. They are still your design - You should tell them to remove them from the server, just becuase the index page is down doesnt mean its over

Well, at least I learned something from this. Always look through server logs -- they could mean the difference between life and ... death ... for your site!

It's great that everything is working out so far for you.

A great design like that should be protected.

The company have completely ripped the design from my own site! They haven't copied it very well either...
For comparison, the genuine article is here:
    http://www.subblue.com

Other than write a stern email what can I do? (the company is based in Hong Kong - and Iím in the UK). If it really came to the crunch i have all the photoshop and illustrator source files to prove that it is my design - but it's bloody annoying that someone has the cheek to rip off my work and call it their own.

    Your thoughts would be appreciated!
Wow, dude... I'd copy your sight! Thats beautiful! Nice job on that one dude.(I wouldn't actually rip it off, just kidding there). Anyway, I've had one of my designs ripped off but it didn't bother me because he told me he did it, and he was my friend. Plus the design wasn't NS friendly anyway so, haha.. his loss .

    Hey subBlue,

    Congratulations!!

Site 203.186.11.193 checked on June 20, 0:59 (Central Time) and I only see a directory listing.

We better keep an eye on it for a few days, just in case

    Paul

    subBlue,

BTW I followed Sparkie's advise and checked the Library of the Congress web site. Hong Kong is only suscribed to the World Trade Organization (Jan. 1, 1995) and China to this

    Bilateral Jan. 13, 1904 5
    Bilateral Mar. 17, l992 9
    Berne Oct. 15, 1992 (Paris)
    UCC Geneva Oct. 30, 1992
    UCC Paris Oct. 30, 1992
    Phonogram Apr. 30, 1993

So you and your lawyer have enough tools to claim justice, if this or other web site steals your designs!!
