I apologize if this is not the appropriate forum, but I thought I'd mention something I read over at mezzoblue, the parent site for CSS Zen Garden.

Apparently, Dave's having some difficulty with a miscreant who won't respect his request to stop treating the CSS files as templates and is instead repackaging them wholesale for redistribution. He's to the point of re-examining the licensing terms for the material on the site.

He cannot stop anyone from taking the css wholesale, because he licensed it that way.

I believe that if it is a company then (in some countries certainly) you can register your look and feel, a bit like a trademark. While this would not stop people ripping off the CSS it would give some recourse if other major sites (in the country that you had registered in) start using it without changing anything about it.
This is certainly true of a registered logo or graphic.
It was clearly stated that the culprit contacted the copyright holders of the graphics for permission, and didn't use those he didn't get permission for.

Actually it doesn't say much for the intelligence of the person nicking the CSS because as far as I have seen if you are changing the graphics, colours and fonts of a style sheet all you are left with is the positioning structure and there must be a gazzillion pages of freely available material out there posted as tutorials and CSS libraries that people are expecting to be copied without having to resort to nicking someone's private design and causing them and yourself lots of hassle.
Does this (Licensing) sound like a subject for a sub-forum under Business and Legal issues ? I mean for creative commons, GNU and the like.

Hmmm... They changed the license. Now the CSS files are not usable. However, legally it is very difficult to change a license retroactively. Wonder what kind of grandfathering a court would give. I would think that any CSS file created and contributed up until the date of the license change would still legally be under the Creative Commons license and that any new template would be under the new license.
He may have just opened up a whole new can of worms by doing this.
