    Hi There

    I am hesitating to sign up with Burst because of a sentence in the liability part of the contract that says I have to defend them if they get sued because of me.

    Has anyone here ever had and legal issues with Burst! ?

    If you use Burst and haven't please post, just so I can see how many people it isn't a problem for.

    As far as I know, a lot of networks have clauses similar to that. They need to be protected in case you do something illegal on your site and for some strange reason burst ends up getting into the legal battle. I have never heard of an ad network getting sued because of the content on one of there member sites so I don't see this clause as a major problem. Of course, that is just my opinion.

    I use Burst! and haven't had any legal problems with them...

    I could see where they are comming from because if you run like a warez site, they might get sued, so you have to defend them, essentially your still defending your site.

    luckily, I don't run a warez site. Only thing on my site isn't mine, and anything I use that is someone elses, I get permission by email first. (Usually applets and stuff.)

    I don't think my site should be a problem, let me know what you think.

    The only causes like that I've seen say that they won't be liable for your site or content. That makes more sense to me.

    For example: what if someone was to gain access to your site because Burst didn't secure it properly. This hacker could then take advantage of this access to cover his or her trail and break into other computers or cause problems that may get traced back to your server. Now, if Burst was sued because of negleting basic security protocols that led to this problem, should you have to pay their legal bills?

    If you are referring to BurstNET Technologies, as I previous client of theirs I can safely say: RUN fast, RUN far. I would not recommend them to anyone, for various reasons.

    Most ad providers have some manner of indemnity notice, for their own (reasonable) protection.

    Common practice under suit is to have everyone in sight subpoenaed -- even if it's just your site that is actually at fault.
